强化检察环节财产查控措施的思考

刑事附带民事赔偿及财产刑“执行难”的原因是多方面的，其中一个关键的原因，在于现行刑事诉讼中侦查、起诉阶段缺乏对犯罪嫌疑人（被告人）合法财产状况的有效掌控，这给刑事赔偿及财产刑的科学裁量及有效执行造成了诸多弊端。因此，建立一套规范、系统、完备的犯罪嫌疑人财产调查控制制度十分必要。

On Property Inspection in Prosecution Phase

The implementation of Criminal Proceedings with civil compensation and property punishment is difficult.There are many reasons,but one of the key reasons is that in the investigation of the current criminal proceedings,the lack of effective control over the legal property of the suspect(defendant) in prosecution phase results in many shortcomings in the assessment of criminal compensation,punishment of property and executions.Therefore,it is essential to establish a set of standard,complete,and systematical measures on the inspection of suspect’s property.
