关于我国死刑制度存废的几点思考

死刑是一种非常古老的刑罚制度,随着社会的文明和进步,近200多年来死刑的存废问题一直受到国内外的普遍关注。目前在我国彻底废除死刑尚不可行,但部分废止死刑是可能的。本文从暴力犯罪、非暴力犯罪的角度对我国死刑的保留、死刑的废除提出了个人的观点。经过剖析我国现有死刑的立法和适用情况,建议在刑罚问题上,应当更新观念,及时废止不必要的死刑设立,国家的立法和司法应当引导社会朝着更文明的方向发展。

Consideration on the Reservation and Abolishment of Death Penalty in Our Country

Deatth penalty is an ancient kind of punishment.With the social civilization and social development,in the past two hundred years many specialists paid close attention to the reservation and abolishment of death penalty.Presently in our country,it is impossible that death penalty is thoroughly abolished.But part abolishment of death penalty is feasible.The author raises some suggestions from the angle of violent crime and non-violent crime.We should renew our idea of death penalty,and legislation and judicature should lead our society to more civilized direction.
