环境民事公益诉讼立法浅探

随着经济的发展,人类赖以生存和发展的环境却不断在恶化,已经严重危害到人们对美好生活的追求。但是,鉴于许多污染和破坏环境的行为不直接损害特定人的利益,在传统的民事诉讼理论的指导下创制的法律,不能有效地约束和制裁这些行为。近年来,许多学者和专家也呼吁建立环境公益诉讼制度,并对在我国实行环境公益诉讼进行了理论研究和论证。文章在此基础上,先从立法的理由、立法的法律基础对在我国进行环境民事公益诉讼立法的急迫行和可行性进行了论述,然后细化分析了具体立法时的几个关键问题,对建立环境民事公益诉讼制度进行了探讨。

An Inqiry into the Legislation on Environmental Civil Litigations for the Public Interests

The economic boom has resulted in such constant deterioration of th e environment,upon which humans' survival and development rely,that people' s pursuit of a better life has been seriously imperiled.Yet,since many incidents of polluti on or environment -damaging acts do n ot directly injure the intere sts of particular individuals,the laws en acted under the guidance of traditio nal civil procedural theories cannot effectively bind and sanction such i nciden ts or acts.As such,in recent y ears,a large number of scholars and experts ha ve appealed for the establishment of a system of environmen tal litigations for the public in-terests and have made theoretical re searches and demonstration o n the en vironmental litigations for the pub lic interests in China.On this bas is,th e authors expound the urgency and feasibility of the legislations on en- vironmental civil litigations in te rms of the reasons and the legal basis of th e legislations.Then they analy se in detail a few key issues in drafting bill a nd finally discuss the establi shment of a system of environmental civil litigat ions for the public int erests.
