| 摘 要： | 通过产品警示缺陷概念及其特征的分析可以看出警示缺陷事故的双方性质。在此基础上，运用边际分析方法得出基于效率目标的警示缺陷认定标准即“合理的可替代警示”标准，运用均衡分析方法来考察警示缺陷的严格责任原则和过错责任原则各自的激励效果，通过对两种归责原则的激励效果进行比较的基础上找出最有效率的警示缺陷归责原则。至此，一个关于警示缺陷归责原则的统一完整的法经济学解释框架便构建而成。 |

On the Analysis of Law and Economics of Imputation Principle of the Product Warning Defect |

| Abstract: | By analyzing the concept and character of product warning defect it is observed that warning defect ac- cident behaves reciprocal nature. Under this, by marginal analysis method it is gotten that the reasonable - alternative - warning standard is the designating standard of product warning defect on the effciency goal, it is to observe the stimulating effect of the strict liability and tort liability of product warning defect, the most efficient imputation principle of product warning defect is to found through comparing the stimulating effect of the above two imputation principle. So a whole explanatory frame of imputation principle of the product warning defect is established. |
