论破产管理人的任职资格

为了保证破产程序的公正、高效进行,各国破产法无不明确规定破产管理人的积极资格与消极资格。我国现行破产法所采用的从政府官员中选任清算组的制度不仅在理论上存在着明显的弊端,而且在实践中也造成了严重的后果。我国应大力提倡从专业人士中选任破产管理人,明定破产管理人的消极资格,肯定破产清算中介机构在破产管理中的主体资格,充分发挥其在破产清算事务中的作用。
