| 摘 要： | 20世纪50年代,德国率先以判例的方式确立了“附保护第三人作用契约”,将债务人合同责任的适用范围扩大至合同之外的第三人,在理论上再次突破了古老的合同相对性原则。同时该制度独特的价值魅力,对我国的司法理论和实践也具有借鉴和指导意义。

| Abstract: | In 1950s, the federal court of Germany took the lead in establishing the institution named Contract with Tying Effect on Protecting a Third Party in the form of prejudications. This institution enlarged the scope of application of the debtor's contractual liability to third party out of the scope of the contract, which in theory broke through the old principle of contractual relativity once more. Meanwhile, its unique value will have the significance of using for reference and guiding in theory and practice of the judicatory in China. |
