依法行政必须建立在科学行政的基础之上

依法行政必须建立在科学行政的基础之上。当前我国科学行政的实现程度比较低,落后的行政管理体制,已经构成了阻碍推进依法行政、建设法治政府的主要矛盾。二者的冲突主要表现为职权法定化原则与管理权限实际界定的非规范性的冲突,法律保留原则、法律优先原则与“条块分割”的行政管理体制的冲突,责权统一原则与权限界定模糊的管理体制之间的冲突。为此必须从实现职权界定的科学化,正确处理垂直管理与地域化管理的关系,强化对抽象政府行为的审查等来实现依法行政与科学行政的统一。

Administration According to Law Must Be Established on the Basis of Scientific Administration

Administration according to law has to be established on the basis of scientific adminis- tration.At present,that the relatively low degree of implementing scientific administration and the backward administrative system has impeded constructing the government of rule of law. These contradictions mainly represented by the conflict between legalization of administrative au- thority and non-normality of administration jurisdiction,the conflict between legal reservation principle,legal priority principle and the segmentation of vertical and horizontal administrative system,the principle of responsibility integrating with power and the vague administrative system of jurisdiction boundary.Therefore,we have to resolve the scientific settlement of administrative authority,deal with the relationship between vertical administration and regionalized administra- tion,reinforce the review for abstract behavior of government,and etc.As a result,the unifica- tion between administration according to law and scientific administration can be achieved.
