网络虚假广告犯罪侦查

传统形式的虚假广告严重地损害了消费者的合法权益,而当前层出不穷的网络虚假广告更是严重阻碍和制约了电子商务健康、有序地发展。网络虚假广告犯罪具有情报信息不易收集、管辖权难以确定、犯罪认定标准不明确、电子证据不易收集和保全等特点,使得针对此类犯罪案件的侦查工作受到极大的挑战。目前,我国尚无专门针对网络虚假广告的法律规定。所以,研究网络虚假广告犯罪并寻求此类犯罪案件的侦查对策显得颇有必要。

The traditional false advertising have seriously damaged the legitimate rights and interests of consumer,and the false advertising on the internet also is to emerge in endlessly,its seriously hindered and conditioned the development of electronic commerce in healthy and orderly way.Crime of false advertising on the internet have some problems,such as not easy to collect crime information,jurisdiction is indefinable,identification standard is not clear and definite,not easy to collect and conserve the electronic evidence,they make the investigation for criminal cases faced with a rigorous challenge.Since there does no exist the law for false advertising on the internet specialized in China.Therefore,research the crime of false advertising on the internet and seek for investigation strategy are more necessary.
