| 摘 要： | 网络犯罪是计算机信息技术发展到一定阶段的产物 ,对网络犯罪的界定应从广义上入手 ,既包括以网络作为犯罪工具 ,也包括以网络作为犯罪对象。我国刑法所涉及到的网络犯罪规定 ,虽然范围较广 ,但存在诸多问题 ,如何从立法上予以完善 ,值得研究。此外 ,在司法对策上加大打击力度 ,提高网络自身的安全性 ,在多个层面上展开国际间的合作等 ,对于遏制网络犯罪同样意义重大。

| Abstract: | Crimes on network is the result of the development of network information systems. It would be better to define the crimes on network in a liberal way to include the use of network as an instrument of crime and as an object of crime. Our penal laws cover a large scope of crimes on network but there are still a lot of problems. It needs further research on how to perfect our legislations. Additionally, it is indispensable to strengthen the judicial countermeasures, increase the safety of networks and enlarge international cooperation in varied levels. |
