| 摘 要： | 作为一种保障性执行措施,查封在民事执行程序中扮演着重要的角色.通过比较我国大陆与台湾地区民事执行中查封制度的异同,评析二者在内涵与方式、查封相关人员、搜查权、查封之限制、标的物保管、查封之效力等方面的优劣,借鉴其先进立法例,对于完善我国动产查封制度具有重要意义.

| Abstract: | As a support enforcement measure, attachment plays an important role in civil execution. It is meaningful for improving attachment of movable property to compare the difference of attachment system in civil execution of mainland and Taiwan, to analyze the good and the bad of them in connotation and way, relevant staff on attachment, right of search, limitation on attachment ,objects deposit and the effectiveness of attachment, and to learn from their advanced legislative instances. |
