| 摘 要： | 诚实信用作为我国《民法通则》所宣示的一项基本原则 ,其在民事司法中的功能集中体现为具有最高的指导作用 ,而不是直接适用于个案的裁判。当我们滥用了这一“帝王条款”的核心价值和功用 ,法律的尊严也将遭遇挑战和侵害。
