人民警察“见危应救”浅探

我国人民警察的“见危应救”是指人民警察基于其法定职责和义务对人身、财产处于危险或灾难的公民应当立即给予拯救和援助。“见危应救”是《人民警察法》规定的人民警察应履行的法定义务之一。“见危应救”的警察主体范围是所有在职在编的人民警察，“见危应救”的时限要求民警迅速前往救助。同时人民警察还应不断提高服务助民的技能。人民警察“见危不救”应承刑事、行政和赔偿费用的法律责任。不属于人民警察危难救助义务范围事项等情形的，人民警察不要承担法律责任。警察“见危应救”与公民“见危应救”不同。

Our country＇ police＇s ＂offering rescue in emergency means that it is the police＇s statutory duties and obligations that persons, property in danger or citizens in disaster should immediately be given to rescue and assistance. ＂offering rescue in emergency＂ is one of the People＇s Police Law＇s statutory obligations that the People＇s Police should fulfill. The connotation and scope, the main body scope of police, the time limit and the rescue skills and the conditions of ＂offering rescue in emergency＂ must be explicit. Policeman who ＂refuse to rescue in emergency＂ should take criminal, administrative and compensation responsibility . As to the situations which don＇t belong tO the scope of rescue, the People＇s Police do not undertake legal responsibility. Police＇s ＂offering rescue in emergency＂ is different from citizens＇ ＂offering rescue in emergency＂.
