| 摘 要： | 我国现今的物权立法采取自然资源由国家和集体组织分别所有的形式,这种立法方式在实践中造成了自然资源权利滥用及权利冲突等现象的发生。自然资源的整体性、社会价值性、有限性和稀缺性的特点,客观上决定了它在法律上的专属性。集体组织自身定位及性质的不确定、事实上的缺位等特点,在主观上也要求废除自然资源的集体所有建立国家专属所有。

| Abstract: | The real - right legislation of natur al resource in our country adopts the form of natural resources being owned by state and collective.This causes the abuse of the res ources right and the confliction of rights.It is necessary to establish exclusi ve ownership of natural reso urces objectively since the resourc es possess unit y,social value,limit a nd scarcity,these four traits.Owin g to the collectiv ity self orientati on,its ambiguous quality and the default in reality,it is c laimed subjectively to abolish the collective ownership but to adopt the state exclusive ownersh ip in the real -right legislation. |
