摘    要:《鹿特丹规则》的通过开启了一个以该规则体系为基础的新海运时代,即“鹿特丹时代”。如同许多国外的情形一样,中国实务界和学界对《鹿特丹规则》也出现了支持和反对的不同观点。应对《鹿特丹规则》持积极肯定态度,《鹿特丹规则》内容本身的相对科学性和合理性,以及多个贸易和航运大国对该规则所采取的积极态度都预示着“鹿特丹时代”到来的不可避免性。中国作为贸易大国和航运大国的双重利益身份,要求中国对该规则采取积极研究和推动的态度,争取建立中国在“鹿特丹时代”国际海运秩序构建中的主导地位,以确保其最大利益。
