| 摘 要： | 当前我国地方性集体合同立法呈现出对企业参与集体合同的强制力逐渐加大,法律刚性不断增强,对协商谈判代表保护逐步完善等特点,未来地方性立法应当注意以下问题:一是要突出协商重点,注重分类指导;二是在运用法律手段的同时要善于借助行政的力量;三是要积极探索符合我国国情的集体争议解决办法;四是要加强对工会集体协商中法律责任问题的研究.

| Abstract: | At present,the characteristics of local legislation on collective agreement include that corporate take part in collective agreement is more compulsory,more rigid of laws,more protection to negotiator and others.In the future,local legislation should pay attention to some issues.Firstly,we should lay stress on the key points of consultation.Secondly,we should resolve problems with the help of administrative power.Thirdly,we should explore the solutions of collective labor dispute meeting with China’s national conditions.Finally,we should research on trade union’s legal responsibility in collective consultation. |
