| 摘 要： | 在刑事诉讼中,社会危险性的程度是在有罪判决生效之前剥夺或限制人身自由的主要依据,因而不仅需要为其设置科学的合乎逻辑的证明标准,而且还应当在具体应用中最大限度的发挥其功能.
