| 摘 要： | 和谐社会必然是法治社会,法治社会又以保障人权为基础与前提。《中华人民共和国治安管理处罚法》是继2004修宪后第一部把“国家尊重和保障人权”作为基本原则的法律位阶的规范性文件。它顺应时代潮流,彰显了以人为本的精神,蕴涵了深厚的人性化理念。本文着重介绍了人权保障原则在《治安管理处罚法》中的体现,论述了和谐社会必定是人权得到保障的社会。
