论判例法的本土化之路——对我国判例法制度建构的几点意见

遵循先例是法治的基本要求。在中国建立判例法制度是老生常谈的一个议题。判例法本土化对于我国司法实践有重大的意义。然而,尽管众多法律工作者在理论界与法律实践中,对此问题进行了诸多探讨与尝试,但是直到今天判例法本土化问题依然没有得到很好的解决,我国判例法的实践现状令人堪忧。我国司法工作者们应当尽快建立起适合我国国情的判例法制度。

On the Localization Way of the Case Law

Abiding by the basic requirements of the precedent governed by law,the localization of the case law is of great significance for our country's judicial practice.However,due to a variety of reasons,the localization of case law is still need to be resolved,and the practical situation of the case law is worrying.Judiciary workers should establish the system of case law suitable for our country's conditions as soon as possible.
