| 摘 要： | 行政指导是运用国家权力的过程,难免会对相对人利益造成一定的损害,因此,行政指导的法律救济就显得尤为重要。行政指导法律救济的理论基础基于信赖利益保护原则、权力制约原理、行政程序法的目的。当前,我国对于行政指导的法律监督与救济还比较薄弱,实践中,必须畅通行政指导的司法途径,完善行政指导的行政救济,厘清国家赔偿和国家补偿的界限。
