| 摘 要： | 离婚赡养费是指夫妻无过失的一方,因判决离婚而陷于生活困难者,他方纵无过失,亦应给予相当的赡养费,是离婚在夫妻财产关系上的效力之一。我国台湾地区规定的离婚赡养费制度在发挥救济功能的同时,注重维护双方当事人权利义务的平衡,实现社会的公平和正义。该制度对完善我国的离婚经济帮助制度具有重要的借鉴意义。

| Abstract: | alimony payments refers to that the party of the husband and wife without fault, fall in difficulties in lifefor divorce judgment, the other should also give considerable alimony, and, this is one of the divorce validity on themarital property relationship. This divorce payments system keep relief function, at the same time, pay attention tothe balance of rights and obligations between parties, realize social fairness and justice. The system has importantsignificance to perfect our country divorce economic aid system. |
