罪犯申诉机制探析

根据法律规定,罪犯对已经生效的判决不服可以进行申诉,同时罪犯申诉也为审判监督程序的启动提供了重要材料来源,但是由于我国申诉制度本身存在的一些缺陷和不足,从而导致了罪犯申诉难的问题,这对于罪犯权利的保障以及对其改造效果都造成了不良的影响。因此本文从罪犯申诉着手,对完善我国的申诉制度进行探讨,希望能对我国罪犯申诉权的保障以及申诉制度的完善方面有所帮助。

Mechanism of Criminal Complaint

Under the law, the offender can appeal if he refuses to accept the verdict in effect, meanwhile, criminal appeals provides an important source of material for start in trial supervision program, but due to some defects and shortcomings inherent in our complaint system resulting in a criminal complaints difficult problem, which has caused the adverse effects in protecting the rights of criminals and their transformation effects. This paper tries to explore to proceed from criminals to improve our complaints system to, hoping to be helpful in improving the crimi- nal security system and the appeal right perfect.
