生产、销售伪劣产品罪的立法完善

我国现行刑法中的生产、销售伪劣产品罪在立法上存在着一些不足之处,应予完善。在罪名方面,将罪名确定为“生产、销售一般伪劣商品罪”;在犯罪对象方面,将“建筑工程”纳入其中;在金额方面,使用经营金额代替销售金额,使得追究生产伪劣产品的刑事责任成为可能。

On perfecting the legislation against the crime of producing and selling fake and poor products

The legislation against the crime of producing and selling fake and poor products in the present criminal law in China is imperfect and needs perfecting. We can define the crime as " the crime of producing and selling general fake and poor products" ; include "the constructive projects" into the targets of crime -committing; and use the sum of money in operation to replace the sum of money in sale so as to make it possible to give criminal sanction for producing fake and poor products.
