社区矫正之实证考察及路径选择

社区矫正是与监禁刑相对的行刑方式,是促进罪犯顺利回归社会的非监禁刑罚执行活动。自2003年我国开展社区矫正试点工作以来,社区矫正工作取得了斐然成绩,但与此同时也存在着不可忽视的种种问题。随着2009年社区矫正工作在全国实施及2011年《刑法修正案(八)》将依法实行社区矫正正式写入我国刑法,社区矫正进入了新的发展阶段。有鉴于此,需要从观念层面、立法层面、操作层面、社会层面、保障层面进行转变与完善,为社区矫正工作向更高层次发展铺平道路。

An Empirical Study of Community Correction and the Selection of Methods

Community correction,a style of execution which is relative to imprisonment,is a non-custodial punishment activity to promote the smooth return of the offenders to society.Since 2003,China has carried out the experimental work of community correction which has achieved striking results,but at the same time,there are also problems that cannot be ignored.In 2011,the Amendment Eight adds community correction to the criminal law,and thus,it has entered a new stage of development.But there are still a lot of things to do to improve community correction.
