论宪法的核心价值

宪法价值问题在我国的宪法学研究中一直未能受到足够的重视。从众多宪法学教科书及著作有关宪法概念内涵的分析可以看出，实际上自觉或不自觉地将民主作为宪法的核心价值看待。这种认识，建立在对民主的理想化基础上，没有看到民主可能具有的消极方面。实际上，宪法的核心价值应为保障人权，这一点从近代宪法产生的思想基础、过程和实际内容等方面体现出来。

On the Core Value of Constitution

The question of constitutional value has not been taken seriously all the time in the course of constitutional research in China. We can found that democracy has been treated as the core value of constitution consciously or unconsciously through the analysis of the connotation of constitutional concept in many constitutional textbooks and works. Such recognition is built on the idealization of democracy and not find the negative aspects that maybe exist in it. In fact, the core value of constitution should mean the safeguard of human rights, which can be reflected from the thought basis,course,actual contents and so on of the evolution of modern constitution.
