现行劳动教养制度立法问题研究

我国现行劳动教养制度立法中存在劳动教养的法律依据不充分，与其它法律制度和国际人权公约的矛盾与冲突，以及劳动教养法律规范缺乏统一性，执法存在随意性等问题。因此，有必要从立法上完善劳动教养制度。这是完善我国社会主义法律体系，实现依法治国的需要，是维护劳动教养人员合法权益的需要，是适应国际人权领域斗争的需要。
