新司法解释与行政公益诉讼

行政公益诉讼是行政法学界关注的热点问题之一。纵观已有的研究 ,大多局限在行政公益诉讼内涵、与传统行政诉讼的区别、国外行政公益诉讼制度的一般介绍 ,以及建立行政公益诉讼的必要性与可能性的理论阐述上。相比较而言 ,立足于我国行政诉讼制度 ,探讨行政公益诉讼的现实可能性会更有意义。

New Judicial Interpretation and Administrative Public Interest Action

Administrative public interest action is a hot issue in recent years. Most of previous studies are limited in the conditions of administrative public interest action, the difference between administrative public interest action and traditional administrative litigation, introduction of foreign system of administrative public interest action and theories about the necessity and possibility of establishing it in China. There will be more significances if we can research the realistic possibility of administrative public interest action basing upon our system of administrative litigation.
