建立刑事被害人国家救助制度的思考

为实现建立和谐社会的目标,国家应当尽早地制定保护被害人利益的法律制度,并从我国的具体国情出发,在立法时将该制度的性质定为"刑事被害人国家救助法;"该制度应是对被害人的"最后"救助方法;明确救助的范围和不予救助的情况;立法时考虑与其他制度的竞合关系;培育民间援助组织。

Consideration on the Construction of National Compensation System to Criminal Victims

In order to realize the destination of establishing harmonious society,the legal system protecing the interests of victims should be established as early as possible and the nature of the legal system should be "National Compensation to Criminal Victims".The system which shows the definite range of relief and the situation without salvation is the last way of relief to the victims.The relationship of competition and cooperation with other system should be considered and non-official aid organizations should be cultivated at the time of legislation.
