| 摘 要： | 集体所有是一种政治意义上的所有制，而不是法律意义上的所有制；自治结果的正义与民法上的公平正义是两个不同的范畴，有着不同的正义标准；改革集体所有制以期解决当前问题；村民待遇案件问题是一个政治问题，而非法律问题，不应通过司法程序来解决。
