| 摘 要： | 在大陆法系的物权法理论中，土地和建筑物的关系有结合主义和分离主义两种模式，并被不同国家和地区所采用，尽管各有特点，但通过制度比较可知，结合主义模式更具优势。在我国，农村宅基地使用权在尚未放开流转的情形下，与房屋所有权尚处于分离状态。应当改变和完善相关制度，令房屋所有权与宅基地使用权的一并流转即结合主义模式成为我国处理农村房地关系的原则。

| Abstract: | In terms of the property law in the continental law system, there are two forms, corporatism and separatism adopted by different countries and regions with different features. By comparing with systems, corporatism has more advantages. Under the circumstances of restrictions to the right to use house sites in China, it separates from the house ownership. Corporatism should improve and be the principle dealing with the relationship between rural house sites and lands in China. |
