| 摘 要： | 现代缓刑制度的价值基础是公正、谦抑和人道,不体现刑法价值的刑罚制度注定要为人们所抛弃,这是历史推动的结果,也是历史发展的趋向.缓刑制度作为现代刑罚领域的一项重要制度,它的适用和不断完善,体现了刑罚的公正性、谦抑性和人道性,符合非刑罚化的发展趋势,有利于减少犯罪.

| Abstract: | The foundation for the value of modern probation system is justice,modesty and humanity.The penalty system which can not reflect the value of the Criminal Code is destined to be abandoned,which is the result as well as the trend of the development of history.As an important system in the field of modern penalty,probation system,if properly applied and improved,will embody justice,modesty and humanity in the value of penalty.It fits the developing trend of depenalization and helps a lot in the decrease of crime. |
