元明清时期国家法对民间纠纷解决机制的规制研究

元明清时期我国民间纠纷解决机制是多元的,并且国家在法律上往往承认这些民间纠纷解决机制的合法性,使它们成为国家纠纷解决机制的组成部分,进而构建起一个多元化的纠纷解决机制。在这当中国家对属于民间层次上的纠纷解决机制并不是放任不管,而是进行了相应的立法规制。这个时期国家对民间纠纷解决机制的规制主要从四个方面进行:对民间纠纷解决机制主体资格的规制;对民间纠纷解决机制能够解决的纠纷范围的规制;对民间纠纷解决机制解决的效力的规制;对民间纠纷解决机制主体法律责任的规制。通过四个方法的法律规制,把民间纠纷解决机制与国家纠纷解决机制融为一体,构建起多元化下的纠纷解决机制体系。

Study on the Folk Solving Dispute Mechanism Regulated by the State Law in the Periods of the Yuan, Ming and Qing

The Periods of the Yuan,Ming and Qing,The dispute solution mechanism in the folk is various,and the nation always admits their validity,making them a part of solution mechanism of national dispute,thereby builds a multi-facet dispute solution mechanism.Moreover,the nation still puts control in this folk dispute solution mechanism,and sets corresponding legislations.In this period,these legislations were carried out mainly from four aspects:(1)regulations for principle qualifications of folk dispute solution mechanism;(2)the range standardization of which those could be solved among all the folk dispute solution mechanism;(3)management for power of folk dispute solution mechanism;(4)Regulations for law responsibility of major part of folk dispute solution mechanism through legislations of four aspects,folk dispute solution mechanism and national dispute solution mechanism were combined,thus a multi-facet dispute solution mechanism came out.
