传统仲裁与法院附设强制仲裁--美国ADR中两种仲裁形式介评

在美国ADR中有两种仲裁形式一种是历史悠久的传统型仲裁,另一种是近年来兴起的法院附设强制仲裁.同样名为仲裁,是因为后者具有前者固有的一些特征.但是由于适用前提和裁决效力等方面的不同,两者的区别也是显而易见的.不同的特点及产生背景使它们各自具有独立的价值.我国现有的仲裁属于传统仲裁.在我国,借鉴美国ADR的经验创设法院附设强制仲裁,将有助于缓解法院压力,充分利用现有仲裁资源.

Traditional Arbitration and Court-Annexed Compulsory Arbitration--A Discussion on the two Kinds of Arbitration in American ADR

There are two arbitration forms in American ADR,the traditional one and the compulsory one annexed to court. The Latter sprang up recently and got the name for having some innate characteristics of the traditional arbitration.The dilferences between them,however,are obvious due to different presuppesitions of application,adjudiation effects,and independent values.Current arbitration in China belongs to the tiaditional one. Therefore,to establish court-annexed compulsory arbitiation with successful experiences of American ADR would contribute to relaxing the pressure on people's court and full use of current arbitration resources.
