| 摘 要： | 《中华人民共和国公证法》规定，根据违法行为的性质，公证机构、执业公证员和公证当事人、公证事项利害关系人及其他个人或者组织应承担相应的公证法律责任。公证效力法定，公证作用越强、法律地位越高，随之引发的公证争议越多。《公证法》首次确立了公证机构的民事主体地位，各地公证机构被频频推上被告席，并由此牵出一系列问题。必须采取公证责任诉讼救济，保证合法权益的实现。

| Abstract: | According to Notarization Law of P.R.C.,notarization agencies,professional notarization workers,notarization party,notarization related persons and other individuals or organizations should take on the responding legal duty of notarization.The validity of notarization is defined by law.The stronger the notarization function is,the higher the status of law is.The disputes occurred frequently.The Notarization Law confirms the civil main body status of notarization agencies.Some local notarization agencies have been accused frequently and these caused a series of problems.The lawsuit relief of notarization duty should be adopted to realize the lawful interests. |
