| 摘 要： | 为进一步完善我国的辩护制度,仅仅在侦查阶段允许律师为犯罪嫌疑人提供有限的法律帮助是无法很好地保障犯罪嫌疑人的合法权益的。根本的做法应当是,取消"提供法律帮助的律师"与"辩护律师"在称谓上的不同,而统称为辩护律师,在侦查阶段即赋予律师以辩护权以及在侦查阶段即赋予犯罪嫌疑人获得法律援助的权利,以弥补我国现行刑事诉讼法之立法不足,这对于树立我国良好的国际形象具有非常重要的意义。

| Abstract: | In order to consummate the defense system of our country,it's not enough to only provide the suspect with limited legal help,so as to on his behalf for obtaining a guarantor pending trial.The right way is that to give the defense lawyers such rights at the stage of the investigation of meeting with the suspect,consulting case files,investigating evidences,and to give the suspect the right to obtain the legal help from lawyers.That can remedy the legal flaws of our criminal Procedure Law.And it's important for our country to build the international image in the world. |
