立法语言的表述伦理

作为思维的载体,语言既产生于又服务于人际交流和社会实践。基于语言自身的本体论目的价值和语词意义的确定性与不确定性之双重特质,不同语言表述所型塑的行为模式以及基于此上的意义空间并不总是能够确证其是足以导引人类过上幸福生活的正当性行为模式与生存意义,因而任何语言的表述都不可避免地具有道德性,也因而立法者在制定法律的过程中必须遵循语言的表述伦理。笔者认为,立法语言的表述伦理主要有衡平伦理、中庸伦理和公正伦理。

On the Ethics of Legislative Language Expression

Being a carrier of thought,languages originate from and render services for human communication and social practice.Due to their ontological objective values and dual attributes of certainty and uncertainty,behavior modes invented by different expressions of languages and the meaning space based thereon cannot necessarily ensure people to have a good life.Since any expression of languages cannot avoid bearing a tinge of ethics,legislators must have language expression ethics.In this author's opinion,legislative language expression ethics mainly includes equitable ethics,happy-mean ethics and impartial ethics.
