| 摘 要： | 如果说诉权论是关于诉讼出发的理论,那么既判力论可以说是诉讼终结点的理论。目前,德、日等国对既判力论的研究较为深刻、规范和精致,而我国不仅在立法上轻视,且在司法实践中也十分漠视,因此,对既判力论的探讨非常必要。

| Abstract: | If the litigation theory is based on the theory of action,Res judicata then belongs to the theory of final judgement.Nowadays,in countries such as Germany and Japan,the theoretical research has been standard and profoundl.While in our country it has been given less emphasis not only in legislation but in judicial practice,therefore,it is necessary to probe into the theory of res judicata. |
