法制视野下的犯罪控制

犯罪因法而存在,因法而得到规范与治理。法制不是良好社会的完美原则,但无法制则无良好的社会。要实现法治,有效地控制犯罪,必须十分审慎地适用刑罚,将其看作预防犯罪的手段而非目的;必须提高立法质量,切实执法、司法,以实现“良法之治”;必须培养人们的法治观念,在全体公民中形成守法的精神和对现代法治的普遍认同,以此实现社会治安秩序的根本好转。

Controlling Crimes Under the Ken of Legal System

Crimes coexist with law and be standardized and administered by law.Legal system is not the perfect principle of a good society,but a good society won't exist without legal system.To bring ruling-by-law to reality and effectively control crimes,penalty should be applied cautiously and it should be regarded as means of preventing crimes but not the purpose.Legislation quality must be enhanced and conscientiously enforce law and administer justice to realize ruling-by-sound-law.People's concept of ruling-by-law must be fostered to form the spirit of abiding-by-law among citizens and general approval of modern rulingby-law in order to make good order of social public security come true.
