| 摘 要： | 建设工程招标投标作为一种竞争性缔约方式，具体包括建设工程招标、投标、开标、评标、定标和签订合同诸程序。法律规定和交易习惯对各个招标投标缔约程序均有特殊要求。只有符合法律要求的缔约行为才受法律保护，也只有受法律保护的缔约行为才会产生预期的法律约束力，才能达到维护公共利益、保证平等竞争的目的。

| Abstract: | Construction Project Tendering, as means of competing engagement, consists of the stages of tender inviting, tender submitting, tender opening, tender evaluating and determining, and contract signing. During the process of tendering, legal provisions and commercial habits both demand special requirements, yet only the engagements in accordance with legal requirements can enjoy legal protection, and therefore yields the expected legal effect of binding and satisfies the goal of safeguarding public interests and guaranteeing competition on the basis of equality. |
