论行政不作为的国家赔偿责任

行政不作为是相对于行政作为而言的一种违法行政行为。行政不作为侵犯公民、法人和其他组织的合法权益造成损害的 ,国家应当承担赔偿责任。但我国现行《国家赔偿法》对行政不作为的国家赔偿责任没有做出明确规定 ,一定程度上影响了行政相对人的合法权宜。因此 ,应界定行政不作为的含义 ,明确国家对行政不作为承担赔偿责任的必要性及构成要件 ,进一步完善国家立法。

To Analyze the State Compensation Duty on Negative Administration Act

The negative administration act ,which is opposite to administrative behaviour,is one form of illegal administrative act. If the negative administration act invades the legal rights of the citizens ,of the legal persons and of other organizations , the nation should undertake the state compensation duty.But the current national compensatory law has not made clear and definite provisions about the state compensation duty on the negative administration act influencing the legal rights of administrative relative person to a certain degree.Therefore it is necessary to define the negative administration act,to clear the necessity and the important composing elements of the state compensation duty on the negative administration act,to further perfect state legislation.
