| 摘 要： | 采矿权是受法律保护的私权利。由于采矿权受到行政管理的种种限制,使得其在经营过程中容易受到政府的公权力的侵害。对合法采矿权进行有效的保护需完善相关的法律、法规,采矿权人要懂法、守法,各级政府要责任明确,依法办事。

| Abstract: | Mining right is one kind of private rights and should be protected by the law.However,the mining right is limited by the administration,and it is also easy to be violated by the power.The relative law to protect the legal mining right should be improved.The legal coal mining should abide by the law.The duty of the government should make clear.The government should administrate the legal coal mining by the law. |
