行政赔偿义务机关及其改革

目前,我国行政赔偿义务机关的设置模式是分散式模式,这种模式在实践过程中已暴露出例如违反自然公正原则、影响赔偿效率、由于各机关各自为政造成受理和执行的诸多困难等弊端。对行政赔偿义务机关设置的改革思路应是“面向对象”的模式。重构我国行政赔偿义务机关设置模式要换分散为集中,在“大集中”与“小集中”中,选择“小集中”,因为只有“小集中”的模式才是适合我国国情的模式。

China adopts a scatteration way to set up administrative compensation obligation organs.The article puts forward a thinking on reforming the existing pattern of setting up the organs on the basis of analyzing shortages of setting up the organs according to the existing pattern.Having taken the conditions of the country and experience gained at home and abroad into consideration,the author holds that it is workable to adopt a small concentration way to set up the organs.
