论我国救济性基本权利

救济性基本权利在基本权利体系中有着重要的功能,其内容主要包括诉愿权、司法裁判权和物质赔偿权。新中国成立以来的四部宪法当中鲜有救济性权利的规定,而现行宪法文本中的救济性基本权利规定也存在着诸多问题。对此,可以基于现有宪法基础进行完善,改进宪法第41条规定,并增加"司法裁判权"。

On Improving The Relieving Basic Right In China Constitution

Relieving basic right is important in the system of basic rights.It includes the right to appeal,the right of judicial judgment and the right of compensation.Four Constitutions after the foundation of new China have rarely provisions of relieving basic right.There are some problems with the provision of the Constitution in effect too.Therefore,we can do several amendments on the basis of the current constitutional text: to improve the provision of article 41,to provide the right of judicial judgment.
