反思诚信

摘    要:民法中的诚信原则根源于西方的商业法制文化,仅此一点就足以提醒我们,它与源自中 国传统伦理的诚实信用绝不可轻易等同。在现代民法制度中,诚信原则仍旧是意思自治原则的补 充和修正;反思诚信,关键在于客观地评价诚信对私法自治的干预程度,在中国伦理文化的背景之 下,其实质就是界定道德对法律的介入程度。相对于中国传统儒家伦理中以“君子”言行为楷模的 诚实信用,民法中之“诚信”所采用的仅仅是“中人”的道德标准。

Abstract:The principle of bona fides in the civil law originated from the legal culture of western business,which reminds us that it is different from the honesty and the credit in the Chinese tradition of ethics.In the modern system of civil law,the principle of bona fides is still the supplement and amendment to the principle of will autonomy.Rethinking the bona fides lies in objectively valuating the bona fide interference in the private autonomy,the essence of which is to define the ethic interference in the legal field.Compared with the honesty and the credit of the gentleman in the Confucian ethics,the bona fides in the civil law only takes the ethic standard of the " mean (or common) person".
