试论法的精神在风俗习惯留存中的作用

通过对黑格尔法哲学思想的批判,马克思指出,法的关系正像国家的形式一样,既不能从它们本身来理解,也不能从所谓的人类精神的一般发展来理解,相反,它们根源于物质的生活关系,是这种物质的生活关系的总和。众所周知,风俗习惯于人类社会所产生调整作用的时间比法早,那么探寻它们之间如何衔接、有何实质关系以及法律的态度问题就是本文的核心问题。在马克思主义法学理论的导循下,力求通过对法的精神这一理论的诠释,阐明法的精神体现是风俗习惯得以留存和法律认可的理论根基。

On the Spirit of Law in Customs Conservation

Through the critique of Hegel’s philosophy,Marx noted that the relationships in law are like state forms,which can be understood neither from themselves,nor from the general development of so-called human spirit;instead they are rooted in material life relationships and they are the sum total of the said relationships.As we all know,customs regulated human society earlier than laws.It is the core issue of this thesis to explore the combination or connection,the true relationships concerning legal attitude between them.Under the guidance of Marxist theory of law,the authors of this thesis,by means of interpretation of law spirit,seek to clarify that the spirit of law is the theoretical foundation of customs conservation and its legal recognition.
