大国背景下俄罗斯土地使用制度变革述评

俄罗斯土地制度变革已经从所有为重心的私有化转向利用为中心的市场化。在土地利用的二元体系下,俄罗斯法大幅缩限了终生继承占有权、土地永久使用权等用益物权的适用范围,建立以土地租赁权为中心的土地使用制度,这是一种适合在大国且土地市场不完善的社会中实现土地资源有效利用和流转的制度安排。

The Review of Changes of-Russian Land Use System in the View of Big Countries

Russian land system changes have moved from the privatization for all the focus to use as the center of the market.In land-use binary system,the Russian Law has substantially reduced the limit of the right of lifetime inheritable possession and the right of permanent use of a land parcel,and established land use institution on the focus of the right of lease of a land parcel.It is fit for the institutional arrangements to achieve efficient use and transfer of land resources in bid countries whose land market is not perfect.
