民事裁定立法体例考察

民事裁定的立法体例影响着其在诉讼过程中的功能发挥和价值体现。优化的立法体例是以清晰、简约为外部特征,以最大限度地实现立法者对该制度的设计初衷为内在要求的。我国当前的民事裁定立法体例尚处于未能构成体系的初始化阶段。建立健全民事裁定立法体例是目前全面修改民事诉讼法所应注意和考虑的重要方面。

On the Legislation Style of the Civil Ruling

The legislation style plays an important role in demonstrating values and functions in the civil ruling.With regard to an optimized legislation style,being explicit and precise is the external feature,while to accomplish the legislator’s purposes to the maximum is the inherent requisite.Reflecting on the legislation style of civil ruling in our country,it is still in an initiative process and far from being systemic.Therefore,it is suggested that to establish a sound legislation system of civil ruling should be a chief concern in amending the Civil Procedure Law.
