恶意透支型信用卡诈骗罪之批判与重构

近年来,信用卡诈骗罪多发,尤其是恶意透支型信用卡诈骗。虽然这只是个罪,但其影响已经超出个罪的范畴,逐渐发展成为一个社会性问题。在刑事审判实践中,通过对恶意透支型信用卡诈骗罪主客观方面构成要件的解读,发现这一个罪中存在两个悖论。其主要原因是该罪的入罪门槛过低,刑罚权的干预范围过大,同时法律条文自身也存在一些问题。要修订该法条,可以借鉴德国立法模式,将恶意透支型信用卡诈骗行为从信用卡诈骗罪中剥离出来,独立成罪。

Criticize and Reconstruct the Fraud Crime of Malicious Overdraft Type of Credit Card

Recently there is more and more credit card fraud esp.malicious overdraft type of credit card.It is not only a crime but it has become a social problem.There are two wrong ideas on the subjective and objective constitutive requirements of the fraud crime of malicious overdraft type of credit card in criminal trial practices.The main reason is that the threshold of the crime is too low,intervention range of criminal right is too large and there are some problems in legal causes.We can use German legislative model as reference and separate it from credit card fraud.
