论电视节目模板的法律保护

本文着眼于现实生活中的电视节目模板抄袭案例,对我国当前知识产权法律制度下电视节目模板保护状况进行了分析,说明了电视节目模板保护的障碍在于其性质模糊、立法缺失以及知识产权客体扩张和法律滞后性的矛盾,并从知识产权法律体系内部和外部分别提出解决方案。最后肯定了电视节目模板保护的必要性,提出了知识产权法律制度内外结合的双轨保护模式。

Discussion on the Legal Protection of Television Program Formats

This article focused on the plagiarism cases of television program formats in our real life,analyzed the situation of protecting television program formats under our current intellectual property legal system,pointed out the barriers of protecting television program formats are its vague nature,absence of legislation and the contradiction between the expanding of intellectual properties objectives and the lagging of the law,put forward solutions from the external and internal of intellectual property legal system.Finally,the article affirmed the necessity of protecting television program formats and put forward the double-track protection mode with the combination of both the inside and outside of the intellectual property law.
