| 摘 要： | 我国农村集体土地所有权还存在着诸如性质不清、权能不全、主体模糊等弊端。正是因为集体土地所有权的主体不明确,才造成了集体土地所有权的诸多弊端。可以这样说,明确农村集体土地所有权的主体是落实集体土地所有权的关键。本文就集体土地所有权主体的现行法律规定作了一些反思,并对目前学界的几种改革思路进行了评析。在此基础上,笔者提出了重构集体土地所有权主体的一点设想。
