略论民法典中收养制度的设计

收养作为一种确立拟制血亲关系的重要身份行为,其制度设计不仅仅直接关系到养父母子女关系的顺利确立和收养关系当事人合法权益的保障,更关系到公共权力在这一问题上的介入程度和介入方式,故有必要从收养制度的宏观定位和具体结构两个方面入手,在民法典制定这一大背景下讨论收养制度的设计问题,并针对我国现行收养立法提出相应的立法建议。

Design of the Adoption System in the Civil Code of China

Adoption is one of the important conducts of paternity,which can form the parent-child relation of fictitious bloodline.The design of adoption system is of vital importance not only to the formation of relationship between adoptive parents and children and the protection of the rights of the parties to an adoptive relation,but also to the degree and the pattern of the intervention of public power to the problem.On the basis of analysis of the macro-location and construction of the adoption system,the article makes a demonstration of design of the adoption system in our future Civil Code and puts forward legislative suggestions.
